Underwriting Requirements

Medical underwriting is allowed without restriction.
Rating Restrictions

There are no rate caps in the traditional Maryland individual health insurance market. However, for individuals exercising their group-to-individual portability rights provided under the federal Health Insurance Portability and Accountability Act of 1996 (HIPAA), individual market rates may not exceed 200 percent of the base rate.
Issuance of Coverage

Individual health insurance carriers are not required to guarantee issue coverage in Maryland, and elimination riders are permitted, except for the HIPAA-eligible population.
Preexisting Condition Requirements

There is a 4-month look-back and 24-month exclusionary period limit for pre-existing conditions in Maryland individual health insurance policies. Pre-existing conditions may not be considered for HIPAA-eligibles and HMO plans.
Creditable Coverage Requirements

Credit for prior coverage required for people exercising their group-to-individual portability rights under HIPAA.
